Martens Fashion Group B.V., registered with the Dutch Chamber of Commerce under number 34210049, Koningin Wilhelminaplein 13, Tower 1, floor 15, 1062 HH Amsterdam, the Netherlands (“Martens Fashion Group”, “we”, “our”, “us”) is a distributor of fashion brands to retailers. We are committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, disclose and safeguard your information when you visit our website www.martensfashiongroup.com (the “Website”) or receive WhatsApp messages from one of the brands we distribute, in accordance with data protection laws, including the European General Data Protection Regulation (GDPR), as amended and/or incorporated into the laws of the United Kingdom (UK), and other applicable EU, Member State and UK laws. Personal Data We Collect and Process

“Personal data” means any information relating to an identified or identifiable natural person. Depending on how you interact with us, we may process:

  • Data you provide to us directly: your name, email address, phone number, the shop you work for, and records of your communications with us.

  • Data collected automatically on our Website: information about your device and browser, the pages you view and what you click. See “Analytics” below.

  • Data processed by service providers who help us run our Website and business, as described in this policy.

WhatsApp messages for retailers

Retailers who sell our brands can sign up to receive WhatsApp messages from a brand we distribute (for example The Shirt Project or Elbsand). We only message people who signed up themselves, at most a few times a month per brand.

For this we process:

  • your mobile number, your name and the shop you work for;

  • your sign-up or sign-off, with its date and how it was given, as proof of your consent;

  • the messages you send us and your answers to short polls;

  • whether our messages were delivered and read.

The legal basis is your consent, which you can withdraw at any time by replying STOP to the brand’s messages. After that you will not receive further messages from that brand.

We use Meta (WhatsApp Business Platform) to send and receive these messages, Supabase (servers in the European Union, Frankfurt) to store this data, n8n to process messages, and Microsoft to notify our team of messages that need a reply. We keep this data for as long as you are signed up and for two years afterwards, as proof of your consent.

When you contact us by email, phone or a form on this Website, we use the details you provide to respond to you and to manage our business relationship with you.

Special Categories of Personal Data

We do not ask for or intentionally process special categories of personal data (such as data revealing racial or ethnic origin, political opinions, religious beliefs, health, or sexual orientation). Please do not send us such data.

How We Use Your Personal Data

We use personal data to:

  • operate, maintain and improve our Website;

  • send WhatsApp messages about collections, bestsellers and stock to retailers who signed up, and answer their questions;

  • communicate with retailers and business contacts about our brands and services;

  • understand how our Website and messages are used (see “Analytics”);

  • keep our Website and services safe and secure;

  • comply with legal obligations.

Legal Basis To Process Your Personal Data

  • Consent: for WhatsApp messages. You can withdraw your consent at any time; this does not affect processing before the withdrawal.

  • Performance of a contract: where processing is necessary to do business with your shop.

  • Legal obligation: where we must process data to comply with the law.

  • Legitimate interests: to run and improve our Website, to communicate with our business contacts, and to keep our services secure, except where your interests or fundamental rights override these interests.

How We Disclose Your Information

We never sell your personal data. We share it only with service providers that help us run our business and that process it on our behalf:

  • Squarespace: hosting of this Website (see “Squarespace Platform” below);

  • Meta (WhatsApp Business Platform): sending and receiving WhatsApp messages;

  • Supabase: data storage in the European Union;

  • n8n: processing of messages;

  • PostHog: website analytics in the European Union;

  • Microsoft: email and internal notifications.

We may also disclose information where this is necessary to comply with the law, to respond to lawful requests from authorities, or to protect our rights, and within our company group.

Data Retention and Security

We keep personal data no longer than necessary for the purposes described in this policy. WhatsApp-related data is kept as described above. Website analytics data is kept for [retention period set in PostHog].

We take appropriate technical and organisational measures to protect personal data, including encrypted connections (HTTPS), access control and strong passwords for administrative accounts, and collecting only the data we need. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Your Data Protection Rights

Under data protection laws in the European Economic Area and the UK, you have the right to:

  • be informed about how we use your personal data;

  • access your personal data;

  • have inaccurate data corrected;

  • have your data erased in certain circumstances;

  • restrict processing in certain circumstances;

  • receive your data in a portable format where processing is based on consent or contract;

  • object to processing based on our legitimate interests, and to direct marketing at any time;

  • withdraw your consent at any time, as easily as you gave it (for WhatsApp: reply STOP);

  • lodge a complaint with a supervisory authority, such as the Dutch Autoriteit Persoonsgegevens, the authority in the EEA country where you live or work, or the UK ICO.

Squarespace Platform

Our Website is hosted by Squarespace. Squarespace processes personal data as our processor to provide its services, and may act as an independent controller for some data relating to your use of its services. See the Squarespace Privacy Policy for details.

Data Transfers

Some of our service providers, including Squarespace, Meta and Microsoft, are based in the United States, so personal data may be transferred outside the EEA or the UK. Such transfers rely on an adequacy decision (including the EU-U.S. Data Privacy Framework and its UK and Swiss extensions) or on the European Commission’s standard contractual clauses.

Children’s Privacy

Our Website and services are aimed at businesses and are not directed to individuals under the age of 16. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us and we will remove it.

Analytics

We measure visits to this Website with PostHog, with servers in the European Union. PostHog is configured not to place cookies or store anything on your device. We see which pages are visited and what is clicked.

When you arrive through a link in a WhatsApp message from one of our brands, the link contains a random code linked to your shop, so we can see which messages are useful to which retailers. This code contains no name or contact details.

Cookies

Squarespace, our hosting platform, uses functional cookies that are needed to serve this Website securely. Where a cookie banner is shown, Squarespace’s own analytics cookies are only used after you accept them. See the cookies Squarespace uses.

Fonts

This Website uses Google Fonts and Adobe Fonts to display text. To deliver the fonts, these providers may receive information about your browser and device, the page you are viewing, and your IP address.

Third-Party Links

Our Website may link to other websites, such as our brands’ websites and our B2B webshop. Those websites have their own privacy policies, and we are not responsible for their practices.

We may update this Privacy Policy from time to time. We will post the new version on this page and update the “Last updated” date. Changes take effect when they are posted.
